Bihar Judiciary (PCS-J) Preparation Bihar Assistant Prosecution Officer (APO) Preparation

 

EDUCATIONAL QUALIFICATION

(a) A candidate must possess a Bachelor's Degree in Law from a recognized University.

(b) He/She should have at least 2(two) years of experience as practicing Advocate.

(c) The candidate must be a citizen of India;

(d) He/She must be able to speak, read & write Odia and must have passed either the Middle School standard language test in Odia conducted by the Board of Secondary Education, Odisha or the Matriculation (Class-X/10th standard) Examination with Odia as a subject;

 

AGE LIMIT

A candidate must not be below the age of 21 years and above 35 years of age as on the date of application.

AGE RELAXATION

The upper age limit is relaxable by 5(five) years for candidates belonging to Scheduled Caste(SC), Scheduled Tribe(ST), Women, Ex-Servicemen & by 10(ten) years for Persons with Disabilities (whose permanent disability is 40% and more).

Persons with Disabilities belonging to SC/ ST categories are eligible for age relaxation benefit of 15 years.

 

SCHEME FOR EXAMINATION

1.Preliminary Examination (Objective type questions)

2.Mains Examination (Descriptive type questions)

3.Interview (viva voce)

 

PLAN FOR PRELIMINARY EXAMINATION

It will consist of 100 questions each carrying one mark.

This exam will qualifying in nature.

For each correct answer, one mark will be awarded.

There will be a negative marking. For each wrong response, 25% marks will be deducted.

For unattempted questions, "zero" mark will be awarded.

Duration of the examination will be two hours.

 

SYLLABUS FOR PRELIMINARY EXAMINATION

i. The Code of Criminal Procedure, 1973 and Bharatiya Nagarik Suraksha Sanhita, 2023;

ii. The Indian Penal Code, 1861 and Bharatiya Nyaya Sanhita, 2023; and

iii. The Evidence Act, 1872 and Bharatiya Sakshya Adhiniyam, 2023.

Note-1: The standard of the Syllabus/ Paper shall be of LL.B. Course under University examination.

 

PLAN FOR MAINS EXAMINATION

It will consist of 600 Marks.

The Mains Examination will be conducted in 4(Four) papers each carrying 150 Marks.

Duration of the examination for each paper will be two and half hours.

 

SYLLABUS FOR MAINS EXAMINATION

I. PAPER-I:

GENERAL ENGLISH

1. Translation from English to Odia;

2. Translation from Odia to English;

3. Essay;

4. Precise writing; and

5. Comprehension.

II. PAPER-II:

CRIMINAL MAJOR LAWS

1. The Code of Criminal Procedure, 1973 and Bharatiya Nagarik Suraksha Sanhita, 2023;

2. The Indian Evidence Act, 1872 and Bharatiya Sakhya Adhiniyam, 2023; and

3. Indian Penal Code, 1860 and Bharatiya Nyaya Sanhita, 2023.

III. PAPER-III:

CRIMINAL MINOR LAWS

1. The Arms Act, 1959(Act 54 of 1959) and Rules framed there under;

2. The Dowry Prohibition Act, 1961;

3. The Drugs and Cosmetic Act, 1940;

4. The Odisha Excise Act, 2008(Odisha Act 10 of 2013) & Rules framed there under;

5. The Explosive Act, 1884 and Explosive Substances Act, 1908;

6. The Orissa Electricity Supply line material(unlawful possession) Act, 1989;

7. The Food Safety and Standards Act, 2006;

8. The Orissa Forest Act, 1972; and The Orissa Timber and other Forest produce Transit Rules, 1980;

9. The Information and Technology (Amendment) Act, 2008;

10. The Immoral Traffic (Prevention) Act, 1956;

11. The Juvenile Justice(Care and Protection of Children) Act, 2015 (Act 2 of 2016) & Rules framed under;

12. The Motor Vehicles Act, 1988;

13. The Orissa Minor Minerals(Prevention of theft, Smuggling and other Unlawful Activities) Act, 1989;

14. The Probation of Offenders Act, 1958;

15. The Orissa Prevention of Cow Slaughters Act, 1960; and

16. The Wild Life Protection Act, 1972.

IV.PAPER-IV:

MISCELLANEOUS LAWS

1. Drafting of Petitions, Pleadings and Argument;

2. Law of Torts;

3. The Indian Contract Act, 1872;

4. The Transfer of Property Act, 1882;

5. The Indian Limitation Act, 1963; and

6. The Interpretation of Statutes.

NOTE:

1.A candidate shall answer the papers in English except for Translation into Odia.

2.The standard of General English shall be of degree Course and that of other Papers shall be of LL.B Course under University Examination.

 

INTERVIEW (VIVA VOCE)

 It shall be of 50 Marks.
