Bihar Judiciary (PCS-J) Preparation Bihar Assistant Prosecution Officer (APO) Preparation

EDUCATIONAL QUALIFICATION

Must be an Advocate under the Provisions of the Advocates Act, 1961.

Must be practicing as an advocate in courts of Civil and Criminal Jurisdiction in India and must have so practiced for not less than three years as on the last date fixed for submission of application.

Note: A candidate shall-

(1) Produce a certificate from the Presiding Officer from the respective Court / Courts in which he has actually practiced, a certificate "indicating the length of his practice the fact that he is actually practicing at least for a period of three years.

(2) Produce certificates of good character from the Principal of the college or the institution in which he had last studied and from Gazetted Officer or other responsible person not being a relative but who is well acquainted with him in private life.

 

AGE LIMIT

A candidate must have attained the age of 25 years and must not have attained the age of 42 years for SC/ST or Category I of the Backward class, 40 years in the case of persons belonging to Category IIA, IIВ ог IIIА, IIIB of other backward class and 37 years in the case of any other person.

 

SCHEME FOR EXAMINATION

1.Preliminary Examination ( Multiple Choice Type Questions)

2.Mains Examination ( Descriptive Type Questions)

3.Interview ( Viva- Voce)

 

PLAN FOR PRELIMINARY EXAMINATION

It will consist of two Papers and each will be of 100 Marks.

Paper 1 will be divided into 2 parts carrying 50 Marks.

 

SYLLABUS FOR PRELIMINARY EXAMINATION

Paper-1 (Part-1) (50 marks) (Time: one hour and thirty minutes)

Aptitude test containing questions on comprehension and Proficiency in English and Kannada

Paper-1 (Part-II) (50 marks) (Time: one hour and thirty minutes)

General Knowledge-Test of reasoning and mental ability.

Paper-2 (100 marks) (Time: three hours)

Transfer of Property Act, 1882;

Indian Contract 1872

Specific Relief Act, 1963

Indian Constitution;

Limitation Act

Code of Criminal Procedure, 1973/ BNSS,2023

Indian Evidence Act, 1872/ BSA,2023

 

PLAN FOR MAINS EXAMINATION

The Mains Examination shall consist of three papers.

 

SYLLABUS FOR MAINS EXAMINATION

 Law Paper-I

(Maximum Marks: 100) (Time: 3 hours)

(i) Framing of issues.

(ii) Framing of charges.

(iii) Principles of pleading.

(iv) Drafting of pleadings.

 Law Paper-II

(Maximum Marks: 100) (Time: 3 hours)

(i) Code of Criminal Procedure, 1973/ BNSS,2023

(ii) Indian Evidence Act, 1872/ BSA, 2023

(iii) Indian Penal Code, 1860/ BNS,2023

 Law Paper-III

(Maximum Marks: 100) (Time: 3 hours)

(i) Constitution of India.

(ii) Cyber Laws.

(iii) Code of Civil Procedure, 1908.

In both the preliminary and main examinations the candidate must secure not less than 40 percent of the marks in each paper of written examination and in the case of SC / ST candidate must secure not less than 35 percent of the maximum marks in each paper to qualify Viva Voce.

 

INTERVIEW

It will be of 25 Marks.

The candidate's general knowledge, grasp of principles of law and suitability for appointment as Assistant Public Prosecutor-cum-Assistant Government Pleader shall be tested.
